Canberra Couture Terms & Conditions (online)

Definitions

Booking Fee means the amount payable by You at the time of reserving a Dress for hire.

Booking Date means the first day of the Rental Period.

Canberra Couture (we, our, us) means Canberra Couture, its successors and assignors or any person acting on behalf of and with the authority of Canberra Couture.

Current Price means the Price at the time of booking.

Delivery Date means the date that the Dress is delivered to You or the date that the Dress is collected.

Dress means the garment hired from Canberra Couture.

Postage Fee means $30 for return shipping to ACT, NSW, VIC and QLD and $40 for return shipping to WA, NT and SA.

Price (Rental Price) means cost of the hire of the Dress as agreed between Canberra Couture and You.

Price List means the advertised price

Recommended Retail Price means

Rental Period means a period of four (4) days commencing from the Delivery Date. 

“Rental Price” (“price”) means the cost of the hire of the Dress as agreed between Canberra Couture and You.

“Return Date” means the date the Dress is required to be returned to Canberra Couture.

Terms and Conditions means this document

You means the customer.

  1. Operative provisions

 

  • By accessing and using our Website you are accepting these Terms and Conditions and agree to be bound by all terms contained therein.
  • You warrant that you have read and understood these Terms and Conditions.
  • Canberra Couture, in its absolute discretion, reserves its rights to exclude any person from our hiring service.
  • Canberra Couture warrants that at the time of dispatch that the Dress will be free from any visible damage or defects.
  • The Rental Period commences on the date that the Dress collected or delivered to the address nominated by You and shall continue until the Dress is retuned to Canberra Couture or lodged at the post office for return.

 

  1. Bookings

 

  • We take bookings up to 6 months in advance.
  • Bookings are secured upon payment on the Booking-Fee.
  • Bookings may be made in store or through our Website.

 

  1. Payment and Security

 

  • By accepting these Terms and Conditions, You authorise Canberra Couture to charge the credit card, PayPal account or Afterpay account nominated by You to pay the Booking-Fee and the Postage Fee (if applicable).
  • The Price shall be Canberra Couture’s current price. The current price list is located on Canberra Couture's Website.
  • Canberra Couture reserves all rights to vary the Price from time to time. Any change of Price will be advertised on the Price List.
  • Canberra Couture reserves the right to vary the Price in the event of a variation to the User’s requirements. Any variation will be notified to You at our earliest opportunity.
  • Payments must be made by credit card, paypal or in cash at our store.
  • Payment must be made in full prior to the Dress being dispatched.

 

  1. Rental Period, Collections, Returns and Postage

 

  • The Rental Reriod is for a duration of four (4) days which shall commence from the date that the Dress(s) is either collected from our store or delivered to the address nominated by You.
  • Dress(s) may be returned in person by delivering it to our store located in Gunghalin by appointment or by post.
  • The Rental Period shall continue until the Dress is retuned to our store or lodged at the post office for return.
  • If returning the Dress(s) via post, it must be lodged before 4pm on the day of return to ensure it arrives to us on the next day. If the Dress is being delivered to our store in person then the dress must be returned no later than 5pm after the fourth (4th) day.

 

  • Canberra Couture posts to all locations within Australia, including country and regional towns. Once the Dress has been dispatched You may track its location via a tracking number provided by Canberra Couture at the time of dispatch.
  • We use express post satchels which enables a guaranteed next business day delivery to most metropolitan areas, however, please refer to the Australia Post website for further information on the Guaranteed-Next-Day-Delivery network in Australia www.auspost.com.au.
  • It may take longer than one business day for the Dress to be delivered to you if you are located outside of an Australian metropolitan area.
  • Unfortunately Canberra Couture has no control over Australia Post delivery times. Please calculate a timely order as we are not reliable for late delivery. Canberra Couture is unable to offer a refund if the dress is not delivered on time.
  • The fee for return shipping to ACT, NSW, VIC and QLD is $30 and $40 for return shipping to WA, NT and SA. A self-addressed return express post bag we will be dispatched with the Dress.
  • Late returns attract a late fee of 20% of the Rental Price for each day late after the last day of booking. Late fees will be charged to the credit card or paypal account nominated by You.
  • If You have not returned the Dress(s) within fifteen (15 ) days from the Return Date, Canberra Couture will consider the Dress(s) as non-returned and will charge 100% of the RRP minus any amount paid by You to the credit card nominated by You.

 

  1. Cancellations

 

  • Any cancelation must be advised in writing.
  • You may cancel your booking, for any reason, by emailing info@canberracouture.com.au
  • If You cancel your booking by providing notice in accordance with clauses 1 and 5.2 above within seven (7) days of the Booking Date, Canberra Couture will:
    • Provide a full refund of the Booking-Fee paid by you; or
    • Issue You a store credit to the value of 110% of the Booking-Fee to be used with Canberra Couture.
  • No refund, exchange or credit will be offered for cancellations that occur with less than seven (7) days notice.
  • In the event that your Dress is not available on the Booking Date then Canberra Couture may cancel your booking by providing notice in writing. In the event that Canberra Couture cancels your booking then we will endeavor to provide you with as much notice as possible and make every effort to provide an appropriate alternative.
  • In the event of cancellation by Canberra Couture, Canberra Couture will offer You:
    • A full refund of the Booking-Fee; or
    • Issue a store credit to the value of 110% of the Booking-Fee to be used with Canberra Couture; or
    • A an alternative Dress to the value of 110% of the Booking-Fee. Any amount greater than 110% of the Booking-Fee will need to be paid by You.

 

  1. Sizing

 

  • Canberra Couture discloses and the You acknowledge that sizes may vary from designer to designer.
  • Canberra Couture encourages the User to take care when choosing a Dress to ensure that it will fit.
  • Descriptions of the dimensions of a Dress can be found on our Website.
  • You are encouraged to contact us at info@canberracouture.com.au if you have any queries in relation to sizing.
  • No refund, exchange or credit will be offered if You order the wrong size.

 

  1. Cleaning

 

  • Canberra Couture warrants that its Dresses have been professionally cleaned after each use.
  • We use experienced dry cleaners that are familiar with the care instructions.
  • You must not clean or attempt to clean, repair or alter the Dress without Canberra Couture's prior written consent.
  • Canberra Couture may recover from You the full RRP, minus any amount paid, if the Dress is damaged as a result of You cleaning, attempting to clean or altering the Dress by charging the credit card nominated by You.

 

  1. Your obligations

 

  • Complete and absolute ownership of the Dress is at all times vested in Canberra Couture.
  • All risk passes to You at the time of dispatch and You assume all liability for the Dress from the time that it has been dispatched.
  • You must inspect the Dress within two (2) hours of it being delivered to You.
    • You must, within two (2) hours of Delivery, notify Canberra Couture in writing bu emailing info@canberracouture.com.au of any pre-existing damage, soling or defect to the Dress or any failure of Canberra Couture to comply with the order in full.
    • The Dress is deemed to be free of any defects, damage and soiling if You do not provide written notice to the contrary in accordance with clause 3.1 above.
  • You must not clean or attempt to clean, repair or alter the Dress without Canberra Couture's prior written consent.
  • If the Dress is damaged as the result of the Your use of the dress, negligence, or any other act or omission whilst the Dress is in Your possession or control, whether willful or otherwise, You may be liable for the cost of any repair.
  • If the Dress is lost, stolen or damaged beyond repair, whether or not such loss, theft, or damage is attributable to any negligence, failure, or omission by You then You may be liable to pay for replacement of the item.
  • The replacement value of the Dress is the RRP advertised at the time of booking minus the deposit the customer has already paid.
  • Canberra Couture may recover from You the cost of repair, minus any deposit paid, if the Dress is damaged whilst it is in your possession or control by charging the cost of repair to the credit card or paypal account nominated by You.
  • Canberra Couture may recover from You the full RRP, minus any deposit paid, if the Dress is lost, stolen or damaged beyond repair whilst it is in your possession or control by charging the full RRP to the credit card nominated by You.

 

  1. Limitation of Liability

 

  • Canberra Couture will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the Dress.
  • By accepting these Terms and Conditions, You authorise Canberra Couture to charge the credit card nominated by You according to these Terms and Conditions. This payment authorisation is for the goods/services described above, for the amount indicated above only.
  • You warrant that You have lawful authority to use the nominated credit card/ PayPal account and indemnify Canberra Couture against ALL claims pertaining to its unlawful use.
  • If Canberra Couture does not receive payment from your credit card provider or if your credit card is expired or rejected, You agree to pay all amounts due and payable to Canberra Couture upon demand.
  • If any monies payable by You remain unpaid for a period exceeding seven (7) days from the date of demand, You authorise Canberra Couture to charge any outstanding fees and any other amounts owing to Canberra Couture in accordance with these Terms and Conditions against any credit card You have on file with us, including but not limited the credit card used at time of booking the Dress.
  • Canberra Couture reserves its right to take all steps necessary to collect any amounts due from you, including but not limited to legal action and/or using third party collection agencies.
  • You are liable to pay all reasonable costs incurred by Canberra Couture in commencing and continuing recovery proceedings against You.

 

  1. Privacy Policy

 

  • It is necessary for Canberra Couture to obtain personal information to complete Your order. Canberra Couture will not disclose any personal information provided by You to third parties without your consent unless required to do by compulsion of law or as otherwise authorised by You in accordance with these Terms and Conditions.
